Background: When a genetic mutation is identified in a family member, internationally, it is usually the proband’s or another responsible family member’s role to disclose the information to at-risk relatives. However, both active and passive non-disclosure in families occurs: choosing not to communicate the information or failing to communicate the information despite intention to do so, respectively. The ethical obligations to prevent harm to at-risk relatives and promote the duty of care by genetic health professionals is in conflict with Privacy (...) laws and professional regulations that prohibits disclosure of information to a third party without the consent of the proband. In New South Wales, Australia, amendments to Privacy legislation permits such disclosure to living genetic relatives with the process defined under guidelines although there is no legal duty to warn. This study assessed NSW GHP’s awareness and experience of the legislation and guidelines. Methods: An online survey collected demographics; theoretical knowledge; clinical scenarios to assess application knowledge; attitudes; confidence; experience with active non-disclosure. A link to correct answers was provided after completion. Knowledge scores above the median for non-parametric data or above the mean for parametric data were classified as ‘good’ or ‘poor’. Chi square tests assessed associations between confidence and knowledge scores. Results: While many of the 37 participants reported reading the guidelines, there was limited awareness of their scope and clinical application; that there is no legal duty to warn; and that the threat does not need to be imminent to warrant disclosure. No association between confidence and ‘good’ theoretical or applied clinical knowledge was identified. Uncertainty of their professional responsibility was identified and in the several case examples of active non-disclosure that were reported this uncertainty reflected the need for further understanding of the guidelines in regard to the processes required before disclosure was initiated. Conclusions: There is a need for further education and training about the guidelines associated with the legislation that would be relevant to support disclosure. The findings may inform future strategies to support introduction of policy changes in other jurisdictions where similar regulatory regimes are introduced. (shrink)

A review of Jane Bennett's The Enchantment of Modern Life: Attachments, Crossings and Ethics.

In this paper, I explore connections between two disciplines not typically linked: argumentation theory and urban design. I first trace historical ties between the art of reasoned discourse and the idea of civic virtue. I next analyze discourse norms implicit in three theories of urban design: Jane Jacobs' The Death and Life of Great American Cities (1961), Christopher Alexander's A Pattern Language: Towns, Buildings, Construction (1977), and Peter Katz's The New Urbanism: Toward an Architecture of Community (1994). I then (...) propose a set of ‘settlement’ issues of potential interest to both urban designers and argumentation theorists: size, density, heterogeneity, publicity, security, and identity. I conclude by suggesting that the ‘good city’ be seen as both a spatial and a discursive entity. From such a perspective, good public discourse is dependent, at least in part, on good public space; and good public space is defined, at least in part, as a context conducive to good public discourse. [Michael Tye] Externalism about thought contents has received enormous attention in the philosophical literature over the past fifteen years or so, and it is now the established view. There has been very little discussion, however, of whether memory contents are themselves susceptible to an externalist treatment. In this paper, I argue that anyone who is sympathetic to Twin Earth thought experiments for externalism with respect to certain thoughts should endorse externalism with respect to certain memories. /// [Jane Heal] Tye (...) claims that an externalist should say that memory content invoking natural kind concepts floats free of the setting where the memory is laid down and is at later times determined by the context in which the memory is revived. His argument assumes the existence of 'slow switching' of the meaning of natural kind terms when a person is transported from Earth to Twin Earth. But proper understanding of natural kind terms suggests that slow switching (contrary to what is often presupposed) is likely never to be completed. Hence the situation of a person unknowingly transported to Twin Earth is not that his memories switch content but rather that he gets two natural kinds confused. (shrink)

Moran rightly links performance of speech acts to instituting second‐personal normative relations. He also maintains that an audience's recognition of the speaker's intention in speaking is sufficient for the speaker's success in doing the speech act intended. The claim is true on some ways of understanding speech act verbs, but false on others. This complexity of speech act verbs can be explained by seeing how speech acts need to be understood in the context of shared life and cooperative action.

It is argued that the thought of Lady Jane Grey has received too little attention, and that her name and beliefs need to be resuscitated. The work of Levin, DeLisle and others is alluded to, and it is concluded that Grey was a devoted Dissenter of her time with explicit beliefs.

For neoclassical economists, Homo economicus, or economic human, represents the ideal employee: an energetic worker bee that is a rational yet competitive decision-maker. Alternatively, one could view the concept as a cold and selfish workaholic endlessly seeking the accumulation of money and advancement - a chilling representation of capitalism. Or perhaps, as Peter Fleming argues, Homo economicus does not actually exist at all. Freedom of conscience is a core element of human rights respected by most European countries. It allows abortion through the inclusion of a conscience clause, which permits opting out of providing such services. However, the grounds for invoking conscientious objection lack clarity. Our aim in this paper is to take a step in this direction by carrying out a systematic review of reasons by midwives and nurses for declining, on conscience grounds, to participate in abortion. We conducted a systematic review (...) of ethical arguments asking, “What reasons have been reported in the argument based literature for or against conscientious objection to abortion provision by nurses or midwives?” We particularly wanted to identify any discussion of the responsibilities of midwives and nurses in this area. Search terms were conscientious objection and abortion or termination and nurse or midwife or midwives or physicians or doctors or medics within the dates 2000–2016 on: HEIN legal, Medline, CINAHL, Psychinfo, Academic Search Complete, Web of Science including publications in English, German and Dutch. Final articles were subjected to a rigorous analysis, coding and classifying each line into reason mentions, narrow and broad reasons for or against conscientious objection. Of an initial 1085 articles, 10 were included. We identified 23 broad reasons, containing 116narrow reasons and 269 reason mentions. Eighty one narrow reasons argued in favour of and 35 against conscientious objection. Using predetermined categories of moral, practical, religious or legal reasons, “moral reasons” contained the largest number of narrow reasons. The reasons and their associated mentions in this category outnumber those in the sum of the other three categories. We identified no absolute argument either for or against conscientious objection by midwives or nurses. An invisibility of midwives and nurses exists in the whole debate concerning conscientious objection reflecting a gap between literature and practice, as it is they whom WHO recommend as providers of this service. While the arguments in the literature emphasize the need for provision of conscientious objection, a balanced debate is necessary in this field, which includes all relevant health professionals. Hermeneutic research in nursing: developing a Gadamerian‐based research method This paper takes the stance that although there are many different approaches to phenomenological and hermeneutic research, some of these have become blurred due to multiple interpretations of translated materials. Working from original texts by the German philosophers, this paper reconsiders the relevance of phenomenology and hermeneutics to nursing research. We trace the development of Gadamer's philosophy in order to propose a research method based in this tradition. Five steps have been (...) identified as a guide for nurse researchers. In recent years there has been a renewed interest in the work of Rene Girard, thought by many to be one of the most important, if controversial, cultural theorists of the twentieth century. Girard's work is extraordinarily innovative and wide-ranging, cutting across central concerns in philosophy, psychoanalysis, literary theory, anthropology, theology, and sociology. The current status of localization and related concepts, especially localized statevectors and position operators, within Lorentz-invariant Quantum Theory (LIQT) is ambiguous and controversial.1 Ever since the early work of Newton & Wigner (1949), and the subsequent extensions of their work, particularly by Hegerfeldt (1974, 1985), it has seemed impossible to identify localized statevectors or position operators in LIQT that were not counterintuitive—strange—in one way or another; the most striking strange property being the superluminal propagation of the localized states. The ambiguous (...) and controversial status of these concepts arises from the varied reactions that workers have to the strange properties. Some regard them, particularly the superluminal propagation, as utterly unacceptable, and conclude that no precise concepts of localized statevectors and position operators exist in LIQT (Wigner 1973, p. 325-327; 1983, pp. 310-313; Malament 1996). Others downplay the whole issue, on the grounds that current theoretical and experimental practice has no need of sharply formulated concepts of localization, localized states etc. (Birrell & Davies 1984, pp. 48-59; Haag 1992, p. 34). Still others, including ourselves, believe that the superluminal propagation does not lead to causal contradictions, and is not in conflict with available empirical data: so that it should not be ruled out. We also believe that the other strange properties are merely unfamiliar novelties of LIQT which we must simply learn to accept. (Like the superluminal propagation, they do not lead to causal contradictions, nor conflict with available data.) So in this paper, we aim to help remove the ambiguous and controversial status of localization concepts in LIQT. Drawing on a number of recent high-profile cases of corporate corruption, we develop a process model that explains the escalation of deception in corrupt firms. If undetected, an initial lie can begin a process whereby the ease, severity and pervasiveness of deception increases overtime so that it eventually becomes an organization level phenomenon. We propose that organizational complexity has an amplifying effect. A␣feedback loop between organization level deception and each of the escalation stages positively reinforces the process. In addition, moderators (...) are proposed that will halt escalation at various stages. By conceptualizing corporate deception as a social process, the paper contributes to a growing body of research that looks beyond 'bad' individuals for the causes of corporate illegality. (shrink)

In this comprehensive analysis of Jürgen Habermas's philosophy and social theory, Marie Fleming takes strong issue with Habermas over his understanding of rationality and the lifeworld, emancipation, history, and gender. Throughout the book she focuses attention on the various ways in which an idea of emancipation motivates and shapes his universalist theory and how it persists over several major changes in methodology. Her critique of Habermas begins from the view that universalism has to include a vision of gender equality, (...) and she asks why Habermas, despite deeply held concerns about equality and inclusiveness, repeatedly and systematically relegates matters of gender to secondary status in his social and moral theory. She extends her critique to a range of issues in his theory of rationality and examines what she views as his very problematical claims about truthfulness, art, and bourgeois intimacy. The point of Fleming's critique of Habermas is not to dispute universalism, but to build on the key universalist principles of inclusiveness and equality. She is not persuaded by the view, shared by both sympathizers of Habermas and his postmodern critics, that to be for or against Habermas is to be for or against universalism. Her intention rather is to show that Habermas's theory of modernity is so structured that it cannot achieve its universalist aims. Contending that his theory is not universalist enough, she claims that universalism has to be reconceived as a radical, critical, and historical project. (shrink)

Through the explicit introduction of hyperplane dependence as a form of relativistic dynamical evolution, we construct a manifestly covariant description of a single positive energy particle interacting with any one of a large class of “moving” external potentials. In1+1 dimensions, the simplified mathematics allows us to display a number of general properties of solutions to the equations of motion for evolution on hyperplanes.

In this paper I will present conceptions of state reduction and particle and/or system localization which render these subjects fully compatible with the general requirements of a relativistic, i.e. Lorentz invariant, quantum theory. The approach consists of a systematic generalization of the concepts of initial data assignment at definite times, initiation and completion of measurements at definite times, and dynamical evolution as time dependence, to the concepts of initial data assignment on arbitrary space-like hyperplanes, initiation and completion of measurements on (...) arbitrary space-like hyperplanes, and dynamical evolution as space-like hyperplane dependence, respectively. I also briefly discuss the superluminal propagation which emerges from the localization study and the manner in which causal anomalies are nevertheless avoided. (shrink)

The Reeh-Schlieder theorem asserts the vacuum and certain other states to be spacelike superentangled relative to local fields. This motivates an inquiry into the physical status of various concepts of localization. It is argued that a covariant generalization of Newton-Wigner localization is a physically illuminating concept. When analyzed in terms of nonlocally covariant quantum fields, creating and annihilating quanta in Newton-Wigner localized states, the vacuum is seen to not possess the spacelike superentanglement that the Reeh-Schlieder theorem displays relative to local (...) fields, and to be locally empty as well as globally empty. Newton-Wigner localization is then shown to be physically interpretable in terms of a covariant generalization of the center of energy, the two localizations being identical if the system has no internal angular momentum. Finally, some of the counterintuitive features of Newton-Wigner localization are shown to have close analogues in classical special relativity. (shrink)

This essay seeks to link management action with business ethics. It utilizes two conceptual models of decision making to examine the important processes of information gathering and information processing. This analysis is then related to the ethical aspects of a business decision to help explain differences in the selection of ethical criteria.

Wagering contingent on a previous decision, or post-decision wagering, has recently been proposed to measure conscious awareness. Whilst intuitively appealing, it remains unclear whether economic context interacts with subjective confidence and how such interactions might impact on the measurement of awareness. Here we propose a signal detection model which predicts that advantageous wagers placed on the identity of preceding stimuli are affected by loss aversion, despite stimulus visibility remaining constant. This pattern of predicted results was evident in a psychophysical task (...) where we independently manipulated perceptual and economic factors. Changes in wagering behaviour induced by changes in wager size were largely driven by changes in criterion, consistent with the model. However, for near-threshold stimuli, a reduction in wagering efficiency was also evident, consistent with an apparent but potentially illusory decrease in awareness of the stimulus. These findings challenge an assertion that post-decision wagering provides a direct index of subjective awareness. (shrink)

Background: This study was developed as a result of a court case involving conflicts between midwives’ professional practice and their faith when caring for women undergoing abortions in Scotland. Research questions: What are practising Roman Catholics’ perspectives of potential conflicts between midwives’ professional practice in Scotland with regard to involvement in abortions and their faith? How relevant is the ‘conscience clause’ to midwifery practice today? and What are participants’ understandings of Canon 1398 in relation to midwifery practice? Research design: The (...) theoretical underpinning of this study was Gadamer’s hermeneutic out of which the method developed by Fleming et al. involving a five-stage approach was utilised. Participants and research context: The research was conducted in the south of Scotland. A purposive sampling method was used. Eight participants who were practising Roman Catholics familiar with the subject of conscientious objection who were either midwives, lawyers (civil, canon or both) or priests contributed. Ethical considerations: The major ethical issues related to respect for autonomy, maintaining confidentiality and obtaining voluntary informed consent. Parish priests agreed to act as gatekeepers to prospective participants. All legal requirements were addressed regarding data collection and storage. Approval was given by the ethics committee of the university with which one of the researchers were associated. Findings: Three key themes provide an understanding of the situation in which midwives find themselves when considering the care for a woman admitted for an abortion: competing legal systems, competing views of conscience and limits of participation. Conclusion: Clear guidelines for practice should be developed by a multi-professional and consumer group based on an update of the abortion law to reflect the change from a surgical to medical procedure. Clarification of Canon 1398 in relation to what is and is not participation in the procurement of abortion would be of benefit to midwives with a conscientious objection. (shrink)

Chris Fleming examines the connections between William James’ pragmatism and 12-step addiction recovery programs, such as those of Alcoholics Anonymous and Narcotics Anonymous. In doing so, he not only discusses the influence that James’ The Varieties of Religious Experience had on the founders of Alcoholics Anonymous and their development of the first-ever 12-step program but rebuts a critique of the founders’ attempt to apply James’ ideas to their program. Finally, after finding that James’ ideas on mind and epistemology fit (...) quite well with 12-step programs, Fleming presents several observations related to philosophy with an eye toward its history and its connections with the lived realities of human beings. This study is a careful and logical analysis of the concept “free will.” Its aim is to retrieve and defend the idea that the agent has some genuine power of self-determination, that is, that “the agent, as free, is the ultimate creator of her own purposes”. It carefully looks into the mystery of free will without an uncritical jump into speculation. It is logical in that it steadfastly raises arguments on both sides of the issue as it works its way (...) to its thesis. It is a helpful summary of the debate of the last 25 years on free will. Fleming, Daniel J; Ryan, Thomas Three recent phrases of Pope Francis warrant attention and guide this article. First, there is his call for 'witnesses of God's love' in his tribute to modern martyrs. The second is 'the pedagogy of grace' and the work of the Spirit explained in 'Amoris Laetitia'. Third, from the same document, we find his discussion of accompaniment in the process of moral discernment within the church. Non-naturalists claim that the nature of normativity precludes the possibility of normative naturalism. In particular, they think that normative reduction amounts to normative elimination. This is because it always leaves out the normative. In this paper, I examine the force that the normativity objection has against Humean reductionism. I argue that the normativity objection has no argumentative force against reductionism. When it is presented as a bare intuition, it begs the question against reduction. A more interesting reading of the argument (...) claims that the normative cannot be explained in terms of the natural because the natural is arbitrary. Yet, this version of the argument fails as well because the natural is not arbitrary in the relevant sense. The natural is contingent, so what has value is contingent. That is not an elimination of the normative though, because contingent reasons are still reasons. (shrink)

Advice is interesting because it is a relationship that is built upon two asymmetries. Advice concerns what the advisee ought to do. For that reason, considerations of autonomy suggest that the advisee has a greater claim on what matters in deliberation. However, the advisor is wiser than the advisee. That suggests that the advisor has a greater insight into what matters in deliberation. These are the asymmetry of autonomy and the asymmetry of wisdom. To account for both, I argue for (...) informed subjectivism. Informed subjectivism is the view that the quality of advice is determined by the likelihood that the advisee would consistently prefer acting on the advice to not acting the advice. The theory captures the asymmetry of autonomy by making the quality of advice based on the advisee’s judgment. It captures the asymmetry of wisdom by making the relevant judgments of the advisee be ones that are informed by experience. (shrink)

While abortion has been legal in most developed countries for many years, the topic remains controversial. A major area of controversy concerns women’s rights vis-a-vis the rights of health professionals to opt out of providing the service on conscience grounds. Although scholars from various disciplines have addressed this issue in the literature, there is a lack of empirical research on the topic. This paper provides a documentary analysis of three examples of conscientious objection on religious grounds to performing abortion-related care (...) by midwives in different Member States of the European Union, two of which have resulted in legal action. These examples show that as well as the laws of the respective countries and the European Union, professional and church law each played a part in the decisions made. However, support from both professional and religious sources was inconsistent both within and between the examples. The authors conclude that there is a need for clear guidelines at both local and pan-European level for health professionals and recommend a European-wide forum to develop and test them. (shrink)

This is the second of two papers responding (somewhat belatedly) to ‘recent’ commentary on various aspects of hyperplane dependence (HD) by several authors. In this paper I focus on the issues of the general need for HD dynamical variables, the identification of physically meaningful localizable properties, the basis vectors representing such properties and the relationship between the concepts of ‘localizable within’ and ‘measureable within’. In the first paper of (...) this set (Fleming 2003b) I focused on the issues of the relations of HD to state reduction and unitary evolution and addressed comments of Maudlin and Myrvold. The central conclusion argued for in this second paper (§§ 5, 7) is the non-existence of strictly localizable objects or measurement processes and the consequent undermining of the principle of universal microcausality. This contrasts with the existence of strictly localizable properties and results in the consequent priority of the concept of ‘localizable within’ over ‘measureable within’. Neo‐Aristotelian virtue ethics makes essential reference to the notion of a stable, robust character‐trait. It also claims to be constrained by at least a minimal degree of psychological realism. Recent developments in empirical psychology have drawn into question the evidence for the existence of such robust traits, arguing that it rests on what has been called a ‘fundamental attribution error’. Virtue ethics has thus seemingly been made vulnerable to criticisms that it is essentially dependent on an erroneous, folk‐psychological, notion of (...) character and, so, must either abandon their characteristic notion of virtue or forego any pretensions to psychological realism. I develop a two‐pronged response to this objection. First, I argue that there is reason to question much of the empirical evidence and that such evidence as does exist can easily be accommodated by virtue ethics. Next, I argue that even if we allow that neo‐Aristotelian virtue ethical theories does sometimes presuppose a stronger conception of character‐traits than is warranted by the evidence, this does not significantly undermine the virtue ethicist's project. It is the purpose of this study to identify the most-referenced authors, works, periodicals and publishers in business ethics. A computer analysis was made of over eight hundred references taken from fifty-seven recent articles. The result is a special type of bibliography designed to conserve time for readers in this field. The two most-cited authors were Milton Friedman and Christopher Stone; while the most-referenced works were Where the Law Ends by Stone, Is the Ethics of Business Changing? by Brenner and (...) There is a worry that the ‘major transitions in evolution’ represent an arbitrary group of events. This worry is warranted, and we show why. We argue that the transition to a new level of hierarchy necessarily involves a nonselectionist chance process. Thus any unified theory of evolutionary transitions must be more like a general theory of fortuitous luck, rather than a rigid formulation of expected events. We provide a systematic account of evolutionary transitions based on a second-order regularity of chance (...) events, as stipulated by the ZFEL (Zero Force Evolutionary Law). And in doing so, we make evolutionary transitions explainable and predictable, and so not entirely contingent after all. (shrink)

If the value of the arts is not self-evident, it is difficult to advance arguments to (...) convince those who have no knowledge or affinity with them. Not that many educationists admit to falling into the latter category. As Eisner has said, nobody wants to be seen as a philistine.2 Yet to those with a deep commitment to the value of the arts in education and wider society, the arts are rarely thought to be taken as seriously as they should be.3 This paper will describe five approaches to the question of justifying the arts before examining the specific case of drama and intercultural education.Approaches to Justifying the Teaching of the ArtsFaced with questions of justification, providing a list of reasons for teaching the arts is one approach but not the only one. Instead, looking for broader categories of justification within possible lists (e.g., between art and entertainment, feeling and cognition) exposes differences of emphasis more easily. Exploration of the tension between such concepts as "creating" and "responding" may help get behind bland claims of the kind that the arts can "develop creativity." In this way, the relevance of aesthetic theory, which often centers on the tension between competing concepts, can be demonstrated more readily. Another approach to the question of justification is to reject the idea that the arts should serve instrumental goals at all by advancing an argument in favor of their intrinsic rewards. A fourth approach is to [End Page 54] question whether it is appropriate to seek justification for the arts as a generic concept, rather than looking instead at individual art forms; the benefits of dance may be different in certain respects from those of visual arts. Finally, a priori enquiry could be abandoned altogether in favor of seeing what teachers actually say about their reasons for teaching the arts. Each of these positions will be examined briefly.Mortimer includes physical education and personal and social education among the areas of benefit he attributes to the arts.4 Within five broad categories, he describes further subcategories, amounting to more than seventeen reasons for teaching the arts. He also claims that the arts are a way of developing life skills and attitudes that are transferable across the curriculum and are a way of contextualizing other learning. It is easy to sympathize with someone who is passionate about the arts and concerned that they should be seen as a "fundamental" not as a "frill," but such general claims do not always bring clarity or insight. It is difficult for example to see how poetry "encourages physical confidence in balance." A visit to a children's home may be more fruitful in "developing sensitivity to others." The benefit of "using imagination and creativity" (a catchall phrase that on its own says very little) may in practice find tension with other stated benefits such as "discriminating, selecting, editing." The latter concepts suggest a more constrained, skills-oriented form of teaching rather than an approach that encourages free flow of imagination. Long lists of justifications can obscure theoretical differences and from a tactical point of view in the political arena can appear overblown. They are well meant but not always helpful. Nor do they go far in explaining the deep importance of the arts in so many people's lives.The influential Gulbenkian report in the United Kingdom was wide-ranging in its claims but reinforced the idea of the arts as being an alternative to academic study and what it termed "logico-deductive thought."5 "Society," it argued, "needs and values more than academic abilities." It is over 20 years since Michael Crotty's groundbreaking critique of phenomenological research in nursing. However, rather than entering into the acrimonious discussions that followed, we developed a research method that we believed translated Gadamer's philosophy into the world of empirical research. Fundamental to that work was our differentiation of hermeneutics from phenomenology. The aim of the present paper was to provide a critical analysis of the citations from publication in 2003 until the end of 2017. We identified 402 citations (...) of which 362 were included. One hundred and sixty‐three articles mentioned the article in passing, usually in a list of authors who had discussed hermeneutics. Sixteen citations misrepresented the method mainly claiming that we discussed a method for hermeneutic phenomenology (or phenomenological hermeneutics). Of the 117 citations that partially used the method, the main focus was the four steps of data analysis. Sixty studies used our method in totality although they derive from varying philosophical standpoints. Disappointingly, there has been little critique of our Gadamerian research method. For health disciplines to truly make progress in the academic stage, it is vital that we engage in with critique, some of which will come through open and honest reflexive engagement with our topics. Science fiction is often held up as a particularly philosophical genre. For, beyond actualising mind-experiment-like fantasies, science fiction films also commonly toy with speculative ideas, or else engineer encounters with the strange and unknown. Denis Villeneuve's Arrival is a contemporary science fiction film that does exactly this, by introducing Lovecraft-esque tentacular aliens whose arrival on Earth heralds in a novel, but ultimately paralysing, inhuman perspective on the nature of time and reality. This article shows how this cerebral film invites viewers (...) to confront a counterintuitive model of time that at once recalls and reposes what Gilles Deleuze called a “third synthesis” of time, and that which J. M. E. McTaggart named the a-temporal “C series” of “unreal” time. We finally suggest that Arrival's a-temporal conception of the future as having already happened can function as a key to understanding the fate of humanity as a whole as we pass from the anthropocene, in which humans have...
