Terms of Use

1. Agreement to Terms

By accessing or using egretstudios.com (the "Site") or purchasing any digital product offered through it, you agree to be bound by these Terms of Use and all applicable laws and regulations. If you do not agree to these Terms, you must not access or use the Site.

These Terms constitute a legally binding agreement between you ("you" or "the User") and Egret Studios LLC, a Limited Liability Company organized under the laws of the State of New Mexico (Entity ID: 0008028271), with its principal place of business at 1209 Mountain Road PL NE, Ste N, Albuquerque, NM 87110, United States ("Egret Studios," "we," "us," or "our").

2. Eligibility

You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to create an account or make a purchase on the Site. By using the Site you represent and warrant that you meet this requirement. If you are under the applicable age of majority, you may not purchase products without the consent and supervision of a parent or legal guardian.

3. Digital Products and Licenses

All products sold on the Site — including but not limited to scripts, add-ons, geo-node setups, materials, textures, 3D assets, and any other creative tools or digital files — are digital goods delivered electronically. No physical goods will be shipped.

Upon completing a purchase and receiving confirmation, you are granted a limited, non-exclusive, non-transferable, non-sublicensable license to use the purchased product in accordance with the specific license type displayed on the relevant product page at the time of purchase. License types include, but are not limited to: Royalty-Free, Creative Commons, GPL, MIT, and Editorial Use. The applicable license governs all permitted and prohibited uses of the product.

Unless the applicable license explicitly permits it, you may not resell, redistribute, sublicense, republish, or share the downloaded files — in whole or in part — in any format, through any platform or medium, whether for commercial gain or otherwise. Violation of license terms constitutes copyright infringement and may result in account termination and legal action.

4. Payments and Pricing

All purchases are processed securely through Stripe, Inc. Egret Studios LLC does not store, process, or have access to your payment card information at any time. All prices are listed in United States Dollars (USD). You are responsible for any applicable local taxes or import duties imposed by your jurisdiction. Egret Studios LLC reserves the right to modify pricing at any time; changes will not affect orders that have already been completed.

By completing a purchase you agree to Stripe's Terms of Service and Privacy Policy in addition to these Terms.

5. Refund Policy

Because all products are digital goods delivered immediately upon purchase, refunds are evaluated on a case-by-case basis. We will issue a full refund in any of the following circumstances:

• The file you received is corrupted or fundamentally defective and we are unable to provide a working replacement within a reasonable time.
• The product was materially misrepresented in its description at the time of purchase.
• You were charged in error or experienced an unintended duplicate charge.

Refund requests must be submitted within 14 days of the purchase date. To request a refund, contact us at legal@egretstudios.com with your order ID and a description of the issue. We process all approved refunds through Stripe and they typically appear on your statement within 5–10 business days.

Refunds are not issued for reasons such as: change of mind, incompatibility with software versions not listed in the product's supported range, or failure to read the product description prior to purchase.

6. Account Responsibilities

You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately upon becoming aware of any unauthorized use of your account or any other breach of security. Egret Studios LLC will not be liable for any loss or damage arising from your failure to comply with this obligation.

You agree not to use the Site to engage in any conduct that: violates applicable law; infringes the intellectual property or privacy rights of any third party; distributes malware or harmful code; or attempts to gain unauthorized access to our systems.

7. Intellectual Property

All content on this Site that is not part of a purchased product — including but not limited to text, graphics, logos, UI design, page layouts, and marketing materials — is the exclusive property of Egret Studios LLC or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws. You may not reproduce, copy, modify, distribute, or create derivative works from any Site content without prior written consent from Egret Studios LLC.

8. Disclaimer of Warranties

The Site and all products are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, or non-infringement. Egret Studios LLC does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components, or that any defects will be corrected. Product compatibility with specific software versions is indicated where possible but is not guaranteed beyond the stated supported range.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Egret Studios LLC and its members, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating in any way to your use of — or inability to use — the Site or any product, even if we have been advised of the possibility of such damages. Our total aggregate liability to you for any claim arising under or in connection with these Terms or your use of the Site shall not exceed the total amount you paid to us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Egret Studios LLC and its members, officers, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Site or any product; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit to the Site.

11. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of New Mexico, United States, without regard to its conflict-of-law provisions. Any dispute arising out of or relating to these Terms or the Site that cannot be resolved informally shall be submitted to binding arbitration in Bernalillo County, New Mexico, in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the infringement of intellectual property rights.

12. Changes to These Terms

We reserve the right to amend these Terms at any time. Material changes will be communicated by updating the "Last updated" date at the top of this page. Your continued use of the Site after any such changes constitutes your acceptance of the revised Terms. If you do not agree to the modified Terms, you must discontinue your use of the Site.
