The subpoena, issued on December 1, 2020, was delivered as Trump was preoccupied with efforts to overturn the democratic order and nullify the results of the presidential election he had just lost to <a  href=\"https:\/\/www.rollingstone.com\/politics\/politics-features\/trump-biden-federal-death-row-bloodbath-1235197009\/\"  >Joe Biden<\/a>.<\/p>\n\n\n\n<p\n\t\tclass=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \"\n>\n\tAs BuzzFeed <a  href=\"https:\/\/www.buzzfeednews.com\/article\/hamedaleaziz\/ice-subpoena-buzzfeed-immigration-sources\"  rel=\"nofollow\"  target=\"_blank\"  >reported<\/a> at the time, \u201cImmigration and Customs Enforcement investigators issued a subpoena this week demanding BuzzFeed News identify its sources \u2014 an extraordinary attempt by the government to interfere with a news outlet acting under the protections of the First Amendment, and a move that the agency\u2019s former chief lambasted as \u2018embarrassing.\u2019\u201d&nbsp;<\/p>\n\n\n\n<p\n\t\tclass=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \"\n>\n\tThe aggressive letter from the Trump-era ICE read: \u201cFailure to comply with this summons will render you liable to proceedings in a U.S. District Court to enforce compliance with this summons as well as other sanctions.\u201d It added, \u201cYou are requested not to disclose the existence of this summons for an indefinite period of time. Any such disclosure will impede this investigation and thereby interfere with the enforcement of federal law.\u201d<\/p>\n\n\n\n<p\n\t\tclass=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \"\n>\n\tTo many media and political observers \u2014 including officials who served in the Trump administration who were aware of the document at the time \u2014 the subpoena wasn\u2019t worth the price of the paper on which it was printed. It was a temper tantrum, not a <em>real<\/em> legal threat. For starters, Trump and his officials would be out of a job in less than two months. There wasn\u2019t much will, much less the time, within the federal government to make good on this threat to an <a  href=\"https:\/\/www.buzzfeednews.com\/article\/hamedaleaziz\/ice-fast-track-deportations\"  rel=\"nofollow\"  target=\"_blank\"  >investigative reporter<\/a>, his sources, and his publication. There wasn\u2019t even a chilling effect, <em>per se<\/em>, because their guy had failed at winning reelection.<\/p>\n\n\n\n<p\n\t\tclass=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \"\n>\n\tThat was then.<\/p>\n\n\n\n<p\n\t\tclass=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \"\n>\n\tNow, after vanquishing Vice President Kamala Harris in the 2024 election, Trump and his team have four more years to try to intimidate and target leakers, whistleblowers, and foes in the media \u2014 especially if situations involve what they claim is highly sensitive information or classified intel. They intend to use the opportunity.<\/p>\n\n\n\n<p\n\t\tclass=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \"\n>\n\tIn reporting this story, <em>Rolling Stone<\/em> spoke with attorneys close to the president-elect, incoming Trump administration officials, and other Republicans who\u2019ve talked to Trump about staunching embarrassing press leaks during a second administration. Two of the sources with knowledge of the matter specifically cited the Dec. 1 subpoena as a model, and something that Trump allies and lieutenants are expecting to issue more of during the second term \u2014 this time, with the benefit of years, not days.<\/p>\n\n\n\n<p\n\t\tclass=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \"\n>\n\tIt\u2019s merely one facet of sprawling plans to clamp down on whistleblowers and bully Trump\u2019s enemies in the press, after Trump\u2019s inauguration once again in late January. Expect more communications seizures, more whistleblower prosecutions, and more personal lawsuits or legal threats from Trump against news outlets.\u00a0<\/p>\n\n\n\n<p\n\t\tclass=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \"\n>\n\t\u201cOh, it\u2019ll be brutal,\u201d says one conservative lawyer who\u2019s discussed certain plans and ideas with Trump and his inner circle. \u201cGloves off [because] we\u2019ve learned our lessons from the first time and one lesson is you have got to be even more aggressive.\u201d<\/p>\n\n\n\n<p\n\t\tclass=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \"\n>\n\tOne reason much of the Trumpworld elite wants the gloves torn off is because they are, with good reason, expecting a torrent of leaks to the media after Trump\u2019s inauguration in Washington, D.C., next month. With Trump\u2019s intention to nominate several controversial or scandal-plagued figures to the most senior levels of American government \u2014 including Pete Hegseth to lead the Pentagon, Robert F. Kennedy Jr. to helm the Department of Health and Human Services, Tulsi Gabbard as director of national intelligence, and Kash Patel as FBI director \u2014 Trump and his inner sanctum are predicting officials in various departments and agencies will leak early and often, several of the sources say.&nbsp;<\/p>\n\n\n\n<p\n\t\tclass=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \"\n>\n\tThis is, of course, a matter that Trump cares about deeply. During his first term in the Oval Office, intra-office paranoia and frenzied leak hunts \u2014 both officially by federal investigators and <a  href=\"https:\/\/www.thedailybeast.com\/trumps-top-trade-adviser-peter-navarro-has-a-side-project-secretly-hunting-for-anonymous\"  rel=\"nofollow\"  target=\"_blank\"  >informally<\/a> by zealous Trump aides \u2014 were a hallmark of the administration. But Trumpland isn\u2019t only worried about stamping out leaks, of classified information and other details, from members of what the president-elect and his cronies deride as the \u201cDeep State.\u201d Often, the backstabbing is coming from inside the house.<\/p>\n\n\n\n<p\n\t\tclass=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \"\n>\n\tAccording to two sources familiar with the matter, Trump has personally grown furious about some of the leaks that have occurred from the current presidential transition process, and has in some instances fumingly demanded to know who in his midst could have possibly whispered certain information to the press.<\/p>\n\n\n\n<p\n\t\tclass=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \"\n>\n\tWhen Trump steps back into office, a top priority will be undoing much of the Biden agenda \u2014 and that includes some of the administration\u2019s efforts to limit the extent to which the government can terrorize whistleblowers and leakers.<\/p>\n\n\n\n<p\n\t\tclass=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \"\n>\n\tDuring Biden\u2019s first year in office, his attorney general, Merrick Garland, <a  href=\"https:\/\/apnews.com\/article\/justice-department-reporters-records-merrick-garland-e2348419815ef84dc75cbecd7e546b39\"  rel=\"nofollow\"  target=\"_blank\"  >announced<\/a> that the Department of Justice would bar federal prosecutors \u2014 with some exceptions \u2014 from seizing journalists\u2019 phone records and other private communications during the course of leak investigations.<\/p>\n\n\n\n<p\n\t\tclass=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \"\n>\n\tAccording to several of the knowledgeable sources, some of whom have discussed the topic with Trump in the past year, the president-elect and multiple attorneys in his orbit aim to promptly nix that Biden-era DOJ policy. In the words of one Trump adviser, it\u2019s \u201cgoing in the trash can,\u201d with some Trump officials intent on tearing it up right near the start of Term 2.<\/p>\n\n\n\n<p\n\t\tclass=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \"\n>\n\tAmong committed Trumpists close to the president-elect, there has also been discussion of potentially creating new offices in the FBI or DOJ to focus exclusively on hunting for leaks and plugging the deluge of media leaks. In the summer of 2017, Trumps\u2019 first attorney general, Jeff Sessions, mentioned that the FBI had formed a <a  href=\"https:\/\/www.nbcnews.com\/politics\/justice-department\/sessions-says-trump-administration-has-tripled-number-leak-probes-n789581\"  rel=\"nofollow\"  target=\"_blank\"  >new unit<\/a> to deal with leaks, including of classified info. Sessions also announced that the Trump administration had tripled the number of criminal leak investigations in the time since President Barack Obama left office.<\/p>\n\n\n\n<p\n\t\tclass=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \"\n>\n\t\u201cIn cases where there have been leaks that are criminal in nature, U.S. law enforcement and the incoming attorney general should follow the evidence wherever it leads, regardless of what the prior administraiton\u2019s attorney general thinks, or what the internal memorandum was,\u201d says Steven Groves, who worked as a lawyer in Trump\u2019s first White House.<\/p>\n\n\n\n<p\n\t\tclass=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \"\n>\n\tBoth the Obama and Trump administration attracted significant uproar from press-freedom groups for their secret DOJ seizures of records from reporters and <a  href=\"https:\/\/www.nbcnews.com\/politics\/justice-department\/trumps-doj-secretly-obtained-phone-text-message-logs-43-congressional-rcna183610\"  rel=\"nofollow\"  target=\"_blank\"  >others<\/a>. Whatever record Obama and his Justice Department set, Trump and his senior officials were determined to shatter it. Gurgling beneath the first Trump administration\u2019s rhetorical and propaganda war on his nemeses in political media, there was a ton of real action. For instance, the first Trump administration referred a <a  href=\"https:\/\/theintercept.com\/2021\/03\/02\/trump-leaks-criminal-investigation\/\"  rel=\"nofollow\"  target=\"_blank\"  >record number<\/a> of leaks to the feds for criminal investigations.&nbsp;<\/p>\n\n\n\n<p\n\t\tclass=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \"\n>\n\t\u201cObama\u2019s Justice Department indicted eight journalistic sources under the Espionage Act, more than all U.S. presidents before him combined,\u201d <em>The Intercept<\/em> reported <a  href=\"https:\/\/theintercept.com\/2019\/05\/15\/the-espionage-axe-donald-trump-and-the-war-against-a-free-press\/\"  rel=\"nofollow\"  target=\"_blank\"  >back in 2019<\/a>. \u201cDonald Trump is now surpassing Obama\u2019s eight-year record in just over two years in office.\u201d<\/p>\n\n\n\n<p\n\t\tclass=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \"\n>\n\tThat amped-up war on government whistleblowers was powered <a  href=\"https:\/\/www.cjr.org\/politics\/trump-leaker-arrest-natalie-mayflower-sours-edwards.php\"  rel=\"nofollow\"  target=\"_blank\"  >in part<\/a> by the same Espionage Act under which Trump was criminally <a  href=\"https:\/\/www.rollingstone.com\/politics\/politics-news\/search-warrant-trump-espionage-act-violation-1396193\/\"  >investigated<\/a> and charged in Special Counsel <a  href=\"https:\/\/www.rollingstone.com\/politics\/politics-features\/donald-trump-jack-smith-indictment-jan6-justice-department-1234800968\/\"  >Jack Smith<\/a>\u2019s now-defunct case. The war is set to come roaring back and then some after Trump is sworn in. So far, the twice-impeached former (and future) president, who also became a <a  href=\"https:\/\/www.rollingstone.com\/politics\/politics-features\/donald-trump-defeats-kamala-harris-2024-presidential-election-1235154685\/\"  >convicted felon<\/a> during his 2024 campaign, has named ultra-loyalist Pam Bondi as his choice to lead the Justice Department. Early this month, Trump announced that another hyper-MAGA-devotee, <a  href=\"https:\/\/www.rollingstone.com\/politics\/politics-features\/kash-patel-fbi-director-trump-1235188073\/\"  >Kash Patel<\/a>, was his new pick to serve as FBI director.&nbsp;<\/p>\n\n\n\n<p\n\t\tclass=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \"\n>\n\tPatel has made no secret of his desire to use the levers of federal power to pursue those he views as anti-Trump subversives in the press and government. A year ago, Trump\u2019s choice to take over the FBI told fellow Trump ally Steve Bannon that if Trump won, they\u2019d seriously \u201cgo out and find the conspirators \u2014 not just in government, but in the media,\u201d repeating the anti-democratic lie about \u201cpeople in the media who lied about American citizens, who helped Joe Biden rig presidential elections.\u201d<\/p>\n\n\n\n<p\n\t\tclass=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \"\n>\n\tPatel <a  href=\"https:\/\/www.rollingstone.com\/politics\/politics-features\/kash-patel-fbi-director-trump-1235188073\/\"  >added<\/a>: \u201cWe\u2019re going to come after you. Whether it\u2019s criminally or civilly, we\u2019ll figure that out. But yeah, we\u2019re putting you all on notice, and Steve, this is why they hate us. This is why we\u2019re tyrannical. This is why we\u2019re dictators.\u201d<\/p>\n\n\n\n<p\n\t\tclass=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \"\n>\n\t<a  href=\"https:\/\/www.rollingstone.com\/politics\/politics-features\/if-trump-wins-2024-election-1235096091\/\"  >Indeed<\/a>.<\/p>\n\n\n\n<p\n\t\tclass=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \"\n>\n\tThe sources close to Trump add that non-government actors will be integral to their plans for combatting who they deem overly meddlesome reporters. Multiple sources say that as sitting president, Trump still intends to have his small armada of personal lawyers who aren\u2019t working in the administration handle his (often frivolous) lawsuits \u2014 or, more often than not, enraged legal threats that don\u2019t result in suits \u2014 against media outlets that cross him during a new term.\u00a0<\/p>\n\n\n\n<p\n\t\tclass=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \"\n>\n\tIn the final days of the 2024 campaign, Trump sued CBS for the ludicrous amount of $10 billion \u2014 based on the even more ludicrous idea that the way <em>60 Minutes<\/em> <a  href=\"https:\/\/variety.com\/2024\/politics\/news\/cbs-donald-trump-lawsuit-60-minutes-kamala-harris-1236241754\/\"  target=\"_blank\"  >edited a Kamala Harris interview<\/a> was somehow actionable.&nbsp;<\/p>\n\n\n\n<p\n\t\tclass=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \"\n>\n\t\u201cThe anticipated leaking is a matter of utmost investigative and litigation priority for [us],\u201d says Mike Howell, a former Trump Homeland Security Department official who nowadays works as the executive director at the <a  href=\"https:\/\/www.rollingstone.com\/politics\/politics-features\/trump-project-2025-abortion-campaign-1235071152\/\"  >Heritage Foundation<\/a>\u2019s Oversight Project. \u201cWe have several outstanding lawsuits about leaked information over the last several years that the Trump administration will inherit. A lot of these lawsuits have to do with the FBI, including things that were directly harmful to President Trump \u2026 Therefore, on Day 1 of the second Trump administration, it\u2019ll inherit a bunch of FOIA litigation it\u2019ll have to answer for \u2026 It will already have a duty to figure out how this information left the Biden administration, via leak.\u201d<\/p>\n\n\n\n<p\n\t\tclass=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \"\n>\n\tHowell continues that during the second Trump presidency, \u201cwhenever we see a leak of particular interest out in the press, you can anticipate that we are going to deploy our investigative team and litigation team to figure out how that information left the government. We will use our vast source network and other tools at our disposal to try to identify the source of the leak, to supplement whatever investigation is ongoing.\u201d<\/p>\n\n\n\n<p\n\t\tclass=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \"\n>\n\tIn campaigning on a platform of <a  href=\"https:\/\/www.rollingstone.com\/politics\/politics-features\/trump-not-bluffing-maga-extreme-second-term-1235044464\/\"  >retribution, bloodlust, and authoritarian impulse<\/a>, Trump made no secret of his longstanding desire to punish his enemies in the media. In recent years, Trump has even made the idea of journalists getting raped in prison \u2014 and thus tortured into naming their confidential sources\u2019 identities \u2014 into an audience-pleasing <a  href=\"https:\/\/www.rollingstone.com\/politics\/politics-news\/trump-imagines-journalists-raped-prison-1234626493\/\"  >laugh line at<\/a> some of his rallies.<\/p>\n\n\n\n<p\n\t\tclass=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \"\n>\n\tAs he prepares to take office once again, the president-elect is not hiding his interest in going after journalists.&nbsp;<\/p>\n\n\n\n<p\n\t\tclass=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \"\n>\n\tLast month, the president-elect personally pressured Republican senators to sink the <a  href=\"https:\/\/www.rollingstone.com\/politics\/politics-news\/trump-demands-republicans-kill-press-freedom-bill-1235174184\/\"  >PRESS Act<\/a>, bipartisan reporter-shield legislation. Trump <a  href=\"https:\/\/theintercept.com\/2024\/11\/21\/press-act-trump-press-freedom\/\"  rel=\"nofollow\"  target=\"_blank\"  >posted<\/a> to social media that conservatives \u201cMUST KILL THIS BILL.\u201d But it wasn\u2019t just a social-media post. Trump was invested enough in this matter that he spoke privately and on the phone with certain GOP lawmakers about making sure President Biden never signs this bill, a source with knowledge of the situation and another person briefed on it tell <em>Rolling Stone<\/em>.<\/p>\n\n\n\n<p\n\t\tclass=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \"\n>\n\tThis week, Senate Republicans dutifully <a  href=\"https:\/\/www.cnn.com\/2024\/12\/10\/politics\/senate-gop-blocks-press-protections-bill\/index.html\"  rel=\"nofollow\"  target=\"_blank\"  >blocked<\/a> it.<\/p>\n\n\n\n<p\n\t\tclass=\"paragraph larva \/\/ lrv-u-line-height-copy  lrv-a-font-body-l   \"\n>\n\tOn Thursday, as he accepted <em>Time<\/em> magazine\u2019s \u201cPerson of the Year\u201d award, Trump said <a  href=\"https:\/\/www.independent.co.uk\/tv\/news\/time-magazine-person-year-donald-trump-b2663380.html\"  rel=\"nofollow\"  target=\"_blank\"  >that<\/a> \u201cthe media&#8217;s tamed down a little bit; they&#8217;re liking us much better now, I think,\u201d adding, with a smile: \u201cIf they don&#8217;t, we&#8217;ll have to just take them on again and we don&#8217;t want to
