According to John Rawls, the methods and conclusions of science—when these are non-controversial—constitute public reasons. However, several objections have been raised against this view. This paper focuses on two objections. On the one hand, the associational objection states that scientific reasons are the reasons of the scientific community, and thus paradigmatically non-public in the Rawlsian sense. On the other hand, the controversiality objection states that the non-controversiality requirement rules out their public character when scientific postulates are resisted by a significant (...) portion of the citizenry. The paper replies that both objections miss their mark. To the associational objection, it replies that the relevant test for a reason to be public is whether the reasons have been construed under the rules and constrains of a public frame of thought. Insofar as scientific methods and conclusions correspond to the principles of reasoning and rules of evidence that liberals understand as public, their associational origin is secondary. To the controversiality objection, it replies that the standard for a scientific argument to be regarded as non-controversial should refer to its degree of intra-scientific consensus, since ordinary citizens accept or reject scientific pronouncements conditioned to their particular comprehensive views. Nonetheless, a wide extra-scientific agreement on the epistemic virtues of the scientific method will be needed. The paper concludes that there is a good case to think about scientific reasons as public to the extent that scientific reasoning is a mode of inquiry that mirrors a central aspiration of Rawlsian political liberalism: having a public way of thought and an impersonal standpoint to adjudicate between competing claims. The status of scientific knowledge in political liberalism is controversial. Although Rawls argued that the noncontroversial methods and conclusions of science belong to the kind of reasons that citizens can legitimately call forth in public deliberation, critics have observed that the complexity and elaborateness of scientific arguments drive them away from the spirit of public reason, i.e., that which should reflect judgments that are the product of general beliefs and forms of reasoning found in common sense. In other words, scientific (...) claims remain as inaccessible as esoteric or religious reasons. This paper contends that this objection can be met by introducing a crucial assumption, drawn from W. V. O. Quine and the ‘naturalized epistemology’ tradition: that scientific reasoning and everyday reasoning are not two different epistemic categories but rather form a continuum. The former is just a filtered or refined version of the latter. Accordingly, evidence-based scientific reasoning is common to all citizens, regardless of their actual acceptance of specific scientific claims. Following the Quinean Assumption, political liberals may argue that, unlike religious or esoteric sources of knowledge, scientific reasoning is the expression of a cognitive operation that is fundamentally shared across comprehensive doctrines and politically reasonable individuals. This paper explores whether public reason liberals have an obligation to justify the factual claims that underpin coercive norms. Traditionally, liberal theorists have focused on justifying moral principles, assuming that empirical facts are either (1) not as deeply relevant to people’s lives as moral beliefs or (2) can be easily resolved through expert consensus. However, increasing public disputes over scientific facts and recent findings in cognitive psychology challenge these assumptions. I contest this view by presenting three counterarguments. The Inseparability Argument (...) states that factual and moral claims are deeply intertwined, and many empirical beliefs are rooted in broader worldviews that shape personal identities; the Equivalence of Public Reasons Argument maintains that, insofar as factual claims play a decisive role in shaping coercive policies, they must be subjected to the same justificatory standards as moral claims; finally, the Argument from Epistemic Pluralism claims that liberal societies are not only morally but also epistemically diverse, with citizens holding competing views on what counts as reliable knowledge. Together, these arguments support the existence of a Liberal Duty of Factual Justification (LDFJ), asserting that public reason liberals must engage in the justification of factual premises, as they do with moral principles, to maintain democratic legitimacy. Biological individuals have been at the centre of a series of persistent debates, both in philosophy and biology. Many of these discussions have developed under the assumption that biological individuals form a heterogenous kind of objects comprised by various interrelated sub-kinds, such as evolutionary and physiological individuals. In recent years, however, some works have started to question the overall status of this broad kind, including its explanatory capabilities and other seemingly defensible characteristics that earlier stages of the discussions had taken (...) for granted. This paper follows that trail but starts from a slightly different point. I look at a series of contrasts, ambiguities, and foundational aspects of biological individuality to suggest that biological individuals are more fragmented than usually recognized. (shrink)

A significant and longstanding debate in philosophy of biology has centered around biological individuality. Although there have been numerous attempts to articulate a plausible and unifying view of what makes something a biological individual, the results are often conflicting and non-coextensive. In spite of these disputes, an open consensus around a few general ideas has surfaced (Pradeu 2016a). One common assumption that has been carried over with the consensus is that biological individuality is an intrinsic property of biological entities (Clarke (...) 2016a). This tendency is reflected in the properties typically selected as criteria: what makes something an individual is quite often a property that biological entities themselves possess. I draw on Ellen Clarke’s (2013) evolutionary account of biological individuality, research about the evolution and maintenance of cooperation in the origins of multicellularity (Brockhurst et al. 2007; Gulli et al. 2019), and important parts of the consensus around biological individuality to argue against this trend. What makes something a biological individual is not always something about the entities in question. I show that there are environmental mechanisms capable of acting as individuation mechanisms in circumstances that resemble early transition stages, or in situations where individuality departs from paradigm cases. Therefore, biological individuality is not necessarily an intrinsic property. (shrink)

There have been persistent philosophical efforts to demarcate the province of science. Fewer attempts have been made to explore whether these demarcation strategies are consistent with the liberal promise of religious neutrality. Within this framework, most liberal political theorists seem to agree that hypotheses suggesting supernatural agency should remain outside the purview of science by principle. In their view, this rule of methodological naturalism is neutral in the relevant sense, since it is silent towards ultimate questions. This paper examines whether (...) this is so, especially when discussing the content of the science curriculum in public education. In this context, advocates of the status of Intelligent Design creationism as a scientific theory argue that MN arbitrarily dismisses a type of supernatural agency that is fundamental to several branches of theistic belief. Drawing on Thomas Nagel’s position, the paper contends that MN assumes a meta-scientific position to which either god does not exist, or god does not intervene in cosmic history. To that extend, MN cannot be reconciled with LPRN. However, this conclusion does not entail that hypotheses that suggest supernatural agency must be included in the science curriculum. Creationist theories may remain excluded to the extent that they fall short of the standards that are required for a proficient scientific account. But, crucially, it will not be their religious character what keeps them out of the classroom, but a series of pseudoscientific wrongs which are non-exclusive to supernaturalistic hypotheses. The paper thus suggests the exploration of an alternative demarcation strategy, one that is consistent with LPRN. (shrink)

The philosopher Akeel Bilgrami’s notion of identity is original and challenging to liberal political theory, but still largely unaddressed by it. In a nutshell, Bilgrami characterizes identity as holding certain values and commitments with a crucial addendum: as we want to continue living by those values and commitments in the future, we erect some social and legal barriers to prevent them from change. Liberals of a Millian and/or Rawlsian cast of mind, in turn, arrange political institutions to enable such change, (...) as they assume that we are the kind of creatures that change their minds. In this sense, the identitarian and the liberal mindset are, as the philosopher claims, “mirror opposites”. This article engages with Bilgrami’s view in two senses: on the one hand, it highlights some potentially problematic areas that may call for further clarification and reinterpretation of the liberal canon, as well as offering other set of tensions that arise with non-liberal philosophical traditions. On the other hand, it contends that Bilgrami’s ultimate claim is not merely that the identitarian mindset is more rational than the liberal mentality, as he does, but that it makes political demands that should be assessed against the liberal ideal of justification. While it may be the case that identitarianism is rationally superior to certain versions of comprehensive liberalism, the paper concludes that it loses out to political liberalism, to the extent that Bilgrami’s identitarianism is willing to display the state’s coercive muscle in oppressive ways, in a way that political liberalism does not. This paper proposes extending New Classical Natural Law Theory to the theory of virtues. After a brief personal recollection, the paper begins, in section II, by presenting some of John Finnis’s ideas on the relationship between natural law and the virtues. Section III suggests that there is an incipient theory of virtue in Finnis’s highly developed work on moral principles and human action. The main part of the paper, section IV, aims to explain why a developed theory of virtue is (...) needed in order to supplement New Classical Natural Law Theory. The reasons are: first, to explain both moral good and evil in general and the specification of human actions as good or evil and as different kinds of human actions in genere moris; and, second, to supplement the methodology of moral reasoning, based on first principles of natural law and the requirements of practical reasonableness, with a way of reasoning about good and evil actions by relating specific act-types to certain kinds of virtues and vices. En este artículo describiremos la vitalidad del sistema fonológico del mapudungun hablado por escolares pewenches de la Provincia del Biobío, VIII Región. Específicamente, nos hemos propuesto: a) Determinar los fonos/fonemas, y su fonotaxis, que se relevan como indicadores de vitalidad, b) Identificar las transferencias fonético-fonológicas presentes en la fonología del pewenche hablado por estos escolares y c) Interpretar las transferencias encontradas en términos del grado de vitalidad de la fonología de la lengua. La muestra está conformada por un grupo de (...) 20 escolares bilingües de entre 12 y 15 años de edad, que se encuentran cursando 7° y 8° año básico en escuelas rurales pertenecientes a dos comunidades pewenches del valle del Queuco, en la comuna de Alto Biobío. Para la recolección del material fonológico, se aplicó a los participantes una lista léxica de 65 ítems, material que se complementó con la narración oral en mapudungun de un cuento. Según nuestros datos, hemos podido constatar la existencia de una serie de rasgos fónicos en el mapudungun hablado por los escolares pewenches que obedece a la influencia de las estructuras fonológicas del castellano. Sin embargo, el grado y la difusión de los fenómenos de transferencia se desarrollan de manera heterogénea en ambas comunidades en estudio, debido, entre otros factores, a la intensidad del contacto. In this article we will describe the vitality of the phonological system Mapudungun spoken by Pewenche schoolchildren from the Biobío province, VIII Region. We intend: a) To determine the phones/phonemes, and their phonotactics, which are revealed as vitality markers. b) To identify the phonetic-phonological transferences which are present in the Pewenche spoken by these schoolchildren, and, c) To interpret the transferences found in terms of the degree of the language phonological vitality. The sample is composed of 20 bilingual schoolchildren from 12 to 15 years old, who are in 7th and 8th grade in rural primary schools belonging to two Pehuenche comunities from Valle del Queuco, in the city of Alto Biobío. To collect the phonological material, we applied a 64-item lexical list, which was complemented with the oral narration of a tale in Mapudungun. According to our data, we have been able to verify the existence of a series of phonic features in the Mapudungun spoken by Pewenche schoolchildren, which originate because of the influence of the Spanish phonological structure. However, the degree and spread of the transference phenomena develop in a heterogeneous way in both of the studied communities. due to the contact intensity, among other possible factors. (shrink)

Latin American populism is characterized by its heterogeneity. Considering its three major waves and other political discourses defined as populist, there is no doubt that it is a complex phenomenon in the region. This article aims to provide a political theory of populism and analytical tools to problematize discourse theory by characterizing Latin American populism considering the concepts of autonomy and hegemony. Thus, from a critical analysis of Ernesto Laclau’s theory of populism, considering also plebeian republicanism, performative theory, and the (...) post-hegemony approach, the article proposes an analytical axis between verticality and horizontality to characterize the three major waves and other examples of populist phenomena in the region. In this way, I recognize a radical democratic creative tension between, on the one side, local mobilizations and horizontal expansion of social demands, and, on the other side, populist discourses that emphasize verticality in the figure of the leader, as well as a variety of hybrid forms. En el presente artículo nos proponemos desarrollar y discutir una posible hipótesis de lectura respecto a la obra de la filósofa Catherine Malabou. La crítica de la forma que lleva a cabo desde sus primeros escritos, permite valorarla más allá de la presencia, pero sin apelar a una trascendencia que se plantee por fuera del movimiento de la formación. En esa discusión sobre la forma, Malabou descubre una novedosa idea de materialismo, que hace posible considerar de otro modo la estructura (...) auto-afectiva que subyace al movimiento especulativo y a la naturaleza de la subjetividad. A partir de esta consideración, buscaremos mostrar que una impersonalidad y una indiferencia, que es en cierto sentido un momento de desafección, permite entender de una manera distinta la amplia reflexión sobre la plasticidad, concepto operativo clave que atraviesa gran parte de la obra de Malabou. In this article, I challenge the use of a majority voting rule (majority rule) to declare statutes unconstitutional in many constitutional courts. To do this, I briefly present four main features of majority rule and assess whether these features (separately and jointly considered) provide definitive reasons for using this voting rule over others in constitutional adjudication. I conclude that these features do not provide such reasons either individually or taken together. This conclusion enables one to analyse whether constitutional courts should (...) use other voting rules in constitutional adjudication, such as supermajority rules. (shrink)

Deleuze’s philosophy is permeated with the problem of the continuum. The idea that the coexistence of durations is implied in the concept of duration itself allows Deleuze to offer a fresh perspective on multiplicity, which is distinct from Bergson’s approach, and which proposes new perspectives on the continuum. While Deleuze critiques Leibniz’s view on this concept by highlighting the non-uniform nature of the continuum, the infinitesimal still plays a significant role in his analysis. However, in his late reading of Leibniz, (...) Deleuze emphasises that folds, rather than infinitesimals, should be considered as the smallest components of the continuum’s labyrinth. This implies that there is a union of indiscernible cuts in the continuity, cuts that do not create gaps or breaks in the overall coherence, but rather a labyrinth. I will show how, in exploring this problem, Deleuze and Guattari draw inspiration from Kafka, in order to relate continuity to contiguity. This relation reveals an internal difference that defines the distinction between what is continuous and what is contiguous. This, in our view, marks a considerable shift between Deleuze’s early reading of Bergson and his late reading of Leibniz, and it allows Deleuze to further develop his idea of the continuum. (shrink)

En el presente texto se intenta trazar posibles figuras en que viene a trabarse la relación deconstructiva con la soberanía en el pensamiento de Jacques Derrida. La fuerza y la violencia se asoman como huellas indelebles e inevitables de la soberanía. Pero a la vez la différance derrideana se puede pensar como un despliegue de fuerzas que viene a desorganizar las estructuras sociales, evidenciando que toda fundación política, como la de todo Estado-nación, implica una violencia originaria que es estructuralmente sometida (...) a operaciones de olvido. Deconstrucción y soberanía se trabarían en una relación de fuerza a fuerza, pero para Derrida esto no nos dispensa de atender a una economía de la violencia como primera configuración de esta relación, como una estrategia crítica que busca hacer visibles las violencias ocultas en las jerarquías conceptuales y políticas. Sin ser renunciable este acercamiento crítico, Derrida añadirá la figura de una fuerza débil como registro deconstructivo hacia la soberanía: una configuración de apertura que permite repensar la soberanía no como mero poder opresivo, sino como una posibilidad siempre frágil de justicia vinculada a la alteridad. La noción de una lengua de preestreno, de la espaciación de una lengua siempre por venir, se mostrará como un espacio dentro de la lengua que permitirá traducir estas operaciones deconstructivas hacia nuevas configuraciones políticas siempre por venir, lo que a la vez siempre implica el riesgo del despliegue de crueldades soberanas. This article analyses an important category from Deleuze's philosophy – the notion of intensity – and explores its significance for Deleuze and the ways it can be used to think about poetic cinema. I use the concept of the intensive-image to define a cinematic style that dissipates narrative action in favour of more contemplative and sensory experiences, hence films that are able to turn onscreen reality into purely affective phenomena. The notion of intensity, I argue, does not allow us to (...) reply easily to the question about representation (i.e., “what is the film about?”), mainly because its images are indeterminate and flowing, combined in a multiple manner that excludes any simple reduction to signification. The general argument that follows, illustrated by a careful reading of key poetic texts, is that the focus on the intensive-image inspires readers to reconsider Deleuze's classification of the cinema into two separate periods as well as to understand the ways in which intensity finds expression in films that produce problems, displacements and provocations. In the words of Pasolini, this is the poetic film tradition which must be placed diachronically in relation to the language of the film narrative, a diachronism that, he says, would appear destined to be always more pronounced. In the last section of this article, I look at Luis Buñuel's Un Chien Andalou (1929) as an early case of the poetic image and draw on key theorists and filmmakers who have discussed the cinema's power of affection and intensity. This paper tries to propose a reading focused mainly on some of Foucault’s late works, developed since the first volume of his Histoire de la sexualité, from 1976. The aim of our reading tends to note that the distance between Foucault and Deleuze, even marked in an explicit rupture after the publication of that book, is not so much due to Foucault's “fascination” with power, or to his peremptory challenge of desire and its leakage power, or its supposed abandonment of (...) the detailed analysis of dispositifs. According to our reading, the distance taken by Deleuze will account, in this impasse, for the possibility of a resistance that is not exerted on dispositifs and power formations, and that projects the problem of power towards differents ways of life, according to a logic of modulation of life, very similar to that outlined by Foucault in his later years, and creating a singular consonance between both projects of thought. Ese es el marco de la pretensión de que las universidades privadas, por sus frutos, sean públicas a mismo título que las estatales, y que el fisco deba darles financiamiento. La exégesis del concepto de lo público a partir de las disputas políticas por la libertad religiosa a inicios del cristianismo y el contraste con algunos textos filosóficos modernos y contemporáneos arruinan esa pretensión. Gracias a ese análisis se pueden esclarecer algunos aspectos (...) de la diferencia entre lo privado y lo público, y mostrar que deducir de la pérdida de contornos de lo público la primacía del mercado universitario contiene pretensiones normativas no explícitas en favor de este. Esos aspectos son: 1) la tematización del deseo, sometido a (...) una transformación a partir del concepto de “máquina”, 2) el análisis del capitalismo, a partir de la teorización de un _socius_ específico, donde el deseo adquiere un tratamiento singular, y 3) el descubrimiento de un fascismo molecular, que será desarrollado abiertamente en textos posteriores de ambos autores. RESUMOO problema principal deste trabalho é realizar algumas considerações sobre o problema filosófico da normatividade, tal como ele aparece na obra Wittgenstein on Rules and Private Language, de Saul Kripke (1982). Para tanto, breves considerações sobre o argumento e a resposta céticos do Wittgenstein de Kripke, associadas a considerações sobre fundacionismo e sobre questões constitutivas referentes à normatividade, serão realizadas. Ao final, o texto discutirá brevemente perspectivas sobre como elementos que caracterizam a normatividade poderiam ser explicados adotando-se a via disposicional.AbstractThe (...) main problem of this work is to make some considerations about the philosophical problem of normativity, as it appears in Saul Kripke’s Wittgensensein on Rules and Private Language (1982). To that end, brief remarks on Kripke’s skeptical argument and skepticism, together with considerations of foundationalism and constitutive questions about normativity, will be made. The article examines H.L.A. Hart's most important texts on classical natural law theory in order to assess his understanding of that theory. The author considers first the way of presenting the two meanings of the theory of natural law (namely, moral objectivity and the union of law and morals). Afterwards, he analyzes Hart's thought on the first thesis, especially on the teleology of human nature; then on the second one, especially on the meaning of the invalidity of unjust laws. In (...) both cases, the author compares Hart's understanding with the self understanding of natural lawyers, referring preferably to Aquinas and Finnis. The conclusion is that Hart misunderstood classical natural law theory in such a way that it warranted the suspicion that he did not have a first hand acquaintance with that theory. (shrink)

This paper shows how the republican model of Cicero has been transmitted fragmentarily, through the Italian civic humanist tradition (Maquiavelo), the English republican humanism of XVI, XVII and XVIII centuries, and the republicanism of the American patriots, ("neo-republicanism"). The proposals of Pettit and Brugger are analyzed, and a great variety of positions that some consider "republican" are summarily reckoned. Finally, it is maintained that the classic republican model is present in a very fragmented way in contemporary political theories, for these (...) theories are incapable to accept some strong anthropological, ethical and metaphysical theses. Cicero's model of republicanism appears to us like in a large scale copy or replica, precisely in the political and legal reality of the contemporary world, in its practices and institutions, and in the political function of its theoretical reflections. La primera se relaciona -siguiendo a Foucault- con la ampliación de la pregunta por el "poder" a los campos de normalización social, lo que muestra una coincidencia con la preocupación levinasiana por identificar en la metafísica un movimiento totalizante. Por otra parte, dicha actualidad también corresponde a una necesaria renovación de la filosofía política en el contexto de la destrucción de la historia de la (...) metafísica. La sagacidad de Levinas fue la de haber comprendido la pregnancia de las formas de dominación asociada a la ontología, de tal forma que la política no puede seguir siendo ser pensada como lo había sido hasta entonces sin traicionar su mismo potencial emancipatorio. Levinas est traditionnellement perçu comme une voix critique à propos de la pensée de la totalité de Hegel et, ainsi, comme un philosophe qui cherche à dénoncer la négation de toute différence dans la pensée de l’identité, que ce soit dans l’unité de la vie, de l’esprit, du savoir ou du concept. Or, le paradoxe de Levinas est de critiquer Hegel tout en réinterprétant et en s’appropriant certains de ses concepts fondamentaux. Plus particulièrement, c'est le cas avec la radicalisation de (...) la puissance du négatif. Il s’agit donc de s’interroger sur l’effort de Levinas pour développer une forme intrinsèque à la dialectique hégélienne que Hegel aurait entrevue sans développer dans sa philosophie, encore trop enracinée dans une métaphysique que Levinas tente de quitter. Ce faisant, il s’agit d’éclaircir si l’on peut même parler d’une dialectique négative lévinassienne. (shrink)

El modelo de desarrollo sustentable ha motivado la generación de una importante producción científica en distintos ámbitos. Tal ha sido el caso de la psicología que se ha propuesto comprender el papel de los factores conductuales y mentales implicados en la relación del hombre con la naturaleza. Si bien el emergente campo de la psicología ambiental se ha planteado objetivos pertinentes para el fomento de conductas sustentables, ésta ha operado desde modelos epistemológicos que tienden a mantener elementos de la cosmovisión (...) moderna relacionada con el deterioro ambiental. Se proponen las aproximaciones narrativas de la psicología como una alternativa capaz de subvertir el orden epistemológico. (shrink)

Este texto pretende apresentar algumas posições sobre o problema do gênero, na modernidade. Partindo do diagnóstico de Foucault de que os processos de constituição e de produção do sujeito implicariam ter um modelo de autodeterminação de si, buscamos pensar o problema do gênero por duas vertentes: por um lado, uma proposta de Butler, em que a sexualidade não poderia ser determinada, pois ela sempre resistiria a qualquer forma de normatização; por outro, uma luta por reconhecimento da individualidade que procura incluir (...) todas as possibilidades de autorrealização de si, na esfera jurídica. Nossa proposta é avaliar esses dois modelos e questionar o que poderia estar mais próximo das demandas sociais em relação ao problema do gênero e, de um modo mais amplo, do problema da identidade individual. This paper aims to present certain positions regarding the question of gender in modernity. Starting from Foucault’s diagnosis that the processes of the constitution and production of the subject involve having a model of self-determination, we have attempted to reexamine the question of gender from two different perspectives: on the one hand, Butler’s proposal that sexuality cannot be determined, since it always resists any form of normatization; on the other, the struggle for recognition of individuality which seeks the inclusion into the legal sphere of all possibilities for self-fulfillment. Our aim is to evaluate these two models and to question which of the two might be closer to social demands connected to the issue of gender and, more broadly, the issue of individual identity.
