Abstract

In all complex hazards or harms, pleaded before the Court, by the victims as plaintiffs, and defendants demanding justified exoneration from liabilities, the Court has always set the procedural rule of scrutiny, under the doctrine of ‘duty of care’, on a bipedalism principle of Non-feasance and Misfeasance. Hence, the relevance of the paper, to the conceptualization theory, for duty of care, as a principle and common law doctrine.
