Agreement to Terms

By accessing or using Zest (the "Service"), including our Chrome browser extension, VS Code extension, web application, and websites, you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree, do not use the Service.

Definitions

  • Service: the websites, software, browser extensions, editor extensions, and related services provided by Zest.
  • User or you: any person who accesses or uses the Service.
  • Content: any text, images, code snippets, or materials provided, uploaded, or otherwise made available through the Service.
  • Account: a unique profile registered to use specific features of the Service.

Chrome Extension Specific Terms

When you install and use the Zest Chrome Extension:

  • You grant the extension permission to access browser tabs and website content as necessary to provide code snippet capture and development session tracking features.
  • The extension will collect and process data as described in our Privacy Policy, including URLs of active tabs, authentication information, and content you explicitly choose to capture.
  • You are responsible for ensuring you have the right to capture and share any code or content through the Service, and that doing so does not violate any agreements with your employer or third parties.
  • The extension is provided as part of the broader Zest Service and requires a Zest account to access full functionality.
  • You may uninstall the extension at any time through your browser's extension management interface.

Eligibility and Accounts

You must be legally capable of entering into a binding contract to use the Service. You are responsible for your Account and all activity under it. Keep your credentials secure and notify us of any unauthorized use.

Acceptable Use

You agree not to misuse the Service. Prohibited conduct includes violating applicable laws, infringing intellectual property rights, attempting to interfere with or disrupt the Service, or accessing areas of the Service without authorization.

User Content

You retain ownership of your Content. You grant Zest a limited, non-exclusive license to host, process, and display Content solely as necessary to operate and improve the Service.

Intellectual Property

The Service and its contents (excluding User Content) are owned by Zest or its licensors and are protected by intellectual property laws. No rights are granted except as expressly stated in these Terms.

Third-Party Services

The Service may integrate or interoperate with third-party products. Use of those services may be subject to separate terms and policies.

Payments

If the Service includes paid features, fees and billing terms will be presented at the time of purchase. Taxes, refunds, and cancellation terms will be described in the applicable checkout or plan information.

Termination

We may suspend or terminate access to the Service immediately for any breach of these Terms or for other conduct that may harm the Service or users. You may stop using the Service at any time.

Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

Limitation of Liability

To the maximum extent permitted by law, Zest and its affiliates, officers, employees, agents, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising out of or related to your use of the Service.

Indemnification

You agree to defend, indemnify, and hold harmless Zest from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or related to your use of the Service or violation of these Terms.

Changes to the Service and Terms

We may modify or discontinue parts of the Service at any time. We may update these Terms periodically. If changes materially affect your rights, we will provide notice where required. Your continued use after changes take effect constitutes acceptance.

Governing Law

These Terms are governed by the laws applicable in your place of residence unless mandatory law specifies otherwise. Venue for any disputes shall be as required by applicable law.
