FOR YOUR REVIEW: Draft notice of termination of Rejection Process for Standard Bylaw Amendment (Re: Following up on recent correspondence and announcements)

Dear members of the Empowered Community Administration, As further follow up to the recent notices that were sent to you, please find attached for your review a draft notice to the ICANN Secretary, notifying him and ICANN organization of the termination of the Rejection Process for adoption of the recent Standard Bylaw Amendment to Section 11 of the ICANN Bylaws (concerning the Generic Names Supporting Organization). The draft is essentially the same as the text that had been sent for previous terminations, with the relevant dates and topics updated to reflect this particular action. Please let staff know if you have any edits or concerns related to the draft, which we can assist with sending on your behalf. On a related note, staff understands that the requisite notice from this Administration concerning the reappointment of Mr. Ron da Silva to the ICANN Board is in process. We will notify you of its delivery as soon as we can confirm it. Finally, we note that the expiration of the applicable Rejection Action Petition Period for the FY19 ICANN Budget and Operating Plan will be at 06.59 UTC on 23 June 2018. Should there be no petitions filed to and accepted by any of the Decisional Participants by that date and time, staff will be happy to provide another draft termination notice for your review. On 30 April 2018, the Address Supporting Organization (ASO) notified the Empowered Community of its reappointment of Mr. Ron da Silva to Seat 9 on the ICANN Board of Directors. As the sole designator of ICANN, the Empowered Community must designate all Directors except for the President ex officio (see https://www.icann.org/resources/pages/governance/bylaws-en/#article7) Please let us know if you would like us to draft a brief notice for your review and send on your behalf. On 19 May 2018, the ICANN Secretary notified the Empowered Community Administration of the Board’s action to approve a Standard Bylaw Amendment relating to the Generic Names Supporting Organization (GNSO) (see https://mm.icann.org/pipermail/ecadmin/attachments/20180523/ee719195/Notice… for the amendment sent on 21 May to clarify the notice first sent n 19 May). Under the ICANN Bylaws, this notification initiated a 21-day Rejection Action Petition Period during which any individual may petition a Decisional Participant in the Empowered Community seeking to reject the Board action under Annex D of the Bylaws. This 21-day Rejection Action Petition Period will expire at 11.59 p.m. Los Angeles time on Saturday 9 June (06.59 a.m. UTC on Sunday 10 June). Should such a petition be filed and accepted by the Decisional Participant in question within the Rejection Action Petition Period, a 7-day Rejection Action Petition Support Period will be initiated (during which the Decisional Participant must seek the support of at least one other Decisional Participant) and the Decisional Participant will also have to send a Rejection Action Petition Notice to the Empowered Community Administration. If, however, no Rejection Action Petition Notice is received by the Empowered Community Administration by the end of the Rejection Action Petition Period, the Empowered Community Administration must notify the ICANN Secretary of its certification that the rejection process has been terminated within twenty-four (24) hours of the expiration of the Rejection Action Petition Period. Dear Empowered Community Administration members, The delivery of notice of the Board’s approval of the FY19 Operating Plan and Budget (dated 1 June 2018) initiated the 21-day Rejection Action Petition Period under the ICANN Bylaws. For this action and purpose, this Rejection Action Petition Period will end at 11.59 p.m. US Pacific time on 22 June 2018 (or 06.59 UTC on 23 June 2018). Should a rejection petition be submitted to a Decisional Participant within the petition period and should that Decisional Participant accept that petition (in accordance with its own internal rules and processes), this will trigger a further 7-day Rejection Action Petition Support Period (ending at 11.59 p.m. US Pacific time on 29 June 2018 (or 06.59 UTC on 30 June 2018), during which time that Decisional Participant will need to seek the support of at least one other Decisional Participant. If support for the petition is obtained from at least one other Decisional Participant and the requisite notice provided to the Empowered Community Administration (among others), the Bylaws provide that “ICANN shall, at the direction of the EC Administration, convene a forum at which the Decisional Participants and interested parties may discuss the Rejection Action Supported Petition”. This Community Forum must be conducted within a 21-day period beginning upon the expiration of the Rejection Action Petition Support Period – for present purposes, and assuming all of the above steps have been fulfilled, the requisite Community Forum period will commence at 11.59 p.m. US Pacific time on 29 June 2018 (06.59 UTC on 30 June 2018) and end at 11.59 p.m. US Pacific time on 20 July 2018 (06.59 UTC, 21 July 2018). Please note that Section 2.3(c) of Annex D of the Bylaws states that, “notwithstanding any statement in the Rejection Action Supported Petition, a Rejection Action Community Forum to discuss a Rejection Action Supported Petition relating to an ICANN Budget or IANA Budget may only be held at a scheduled ICANN public meeting if such Rejection Action Community Forum occurs during the Rejection Action Community Forum Period, without any extension of such Rejection Action Community Forum Period” - this means that, for the FY19 Operating Plan and Budget, any Community Forum that may need be scheduled will not take place face-to-face or at an ICANN meeting but will, instead, be conducted via remote participation methods such as teleconference, web-based meeting room and/or such other form of remote participation as the EC Administration selects” (Section 2.3(d), Annex D). Please see Annex D of the Bylaws for the full text describing all the various criteria and steps applicable to a Rejection Action process (https://www.icann.org/resources/pages/governance/bylaws-en/#annexD) including some specific criteria applicable to petitions to reject an ICANN budget.
